Terms of Service

These Terms of Service (the "Terms") constitute a legally binding agreement between you and Ashuza LLC, the operator of the Pulzer service ("Pulzer," "we," "us," or "our"), governing your access to and use of the Pulzer website and application (collectively, the "Service"). By creating an account, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing, or otherwise using the Service, you agree to be bound by these Terms and by the Privacy Policy, which is incorporated herein by reference. If you do not agree to any provision of these Terms, you must not access or use the Service.
2. Eligibility
The Service is intended for users located in the United States and for individuals who are at least thirteen (13) years of age. By using the Service, you represent and warrant that you are located in the United States and that you are at least thirteen (13) years of age.
3. Accounts and Security
- 3.1 Registration. You may be required to register for an account to use certain features of the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.
- 3.2 Credentials. You are solely responsible for maintaining the confidentiality of your username and password and for all activities that occur under your account. You agree not to share your credentials with any third party.
- 3.3 Recovery Phrase. Upon registration, you are issued a twelve-word recovery phrase, which is displayed to you once. The recovery phrase is the sole means by which you may regain access to your account in the event that you lose your password. Pulzer does not store your recovery phrase in recoverable form and cannot retrieve it on your behalf. If you lose both your password and your recovery phrase, your data will be permanently inaccessible and unrecoverable, and Pulzer shall have no obligation to restore such data.
- 3.4 Approval and Revocation. Accounts may be subject to approval by Pulzer prior to the activation of all features. Pulzer reserves the right, in its sole discretion, to suspend, restrict, or terminate any account at any time, with or without cause, including for any actual or suspected violation of these Terms.
4. Acceptable Use
You agree that you will not, directly or indirectly:
- use the Service for any unlawful purpose or in any manner that violates any applicable law or regulation;
- use the Service to generate, transmit, or facilitate content that is unlawful, threatening, abusive, harassing, defamatory, obscene, or that infringes the rights of any third party;
- attempt to circumvent, disable, or interfere with any security, encryption, rate-limiting, or other protective mechanism of the Service;
- access, scrape, harvest, or otherwise collect data from the Service by automated means, or in a manner that exceeds the normal, expected usage of an individual user;
- resell, sublicense, or otherwise commercially exploit the Service or any output generated by the Service;
- use the Service to develop a competing product or service;
- impersonate any person or entity or misrepresent your affiliation with any person or entity; or
- interfere with or disrupt the operation of the Service or the servers or networks connected to the Service.
5. Ownership and License
- 5.1 Your Content. You retain all right, title, and interest in and to the content that you submit to the Service (your "Content"). You are solely responsible for your Content and for ensuring that your Content does not violate these Terms or applicable law.
- 5.2 License to Pulzer. By submitting Content to the Service, you grant Pulzer a non-exclusive, worldwide, royalty-free, sublicensable license to store, process, transmit, and display your Content as necessary to provide the Service to you, including the transmission of your Content to third-party artificial intelligence providers for the purpose of generating responses.
6. Artificial Intelligence Output
Responses generated by the Service are produced by machine-learning models and may be inaccurate, incomplete, outdated, or otherwise unreliable, and may include content generated erroneously. You acknowledge that such output does not constitute professional, medical, legal, financial, or other advice, and you agree not to rely on such output for decisions that could result in harm to you or others. Pulzer makes no representation or warranty concerning the accuracy, completeness, or usefulness of any output generated by the Service.
7. Advertising
The Service is provided free of charge and is supported by the display of contextual advertisements. You acknowledge that the Service may display advertisements in connection with your use and that such advertisements may be selected based on the content of your recent messages, including your most recent prompt. Pulzer does not sell your personal information and does not track your activity across third-party websites.
8. Fair Use
Pulzer may impose rate limits and other usage restrictions in the interest of maintaining the availability and quality of the Service for all users, and reserves the right to modify such limits at any time. Pulzer also reserves the right, in its sole discretion, to modify, suspend, or discontinue any aspect of the Service, including its pricing or business model, at any time, with prospective effect, without liability to you.
9. Third-Party Services
The Service relies on third-party providers, including OpenRouter for artificial intelligence inference and Gravity for advertising, and may integrate with other third-party services. Requests transmitted to OpenRouter are sent with Zero Data Retention (ZDR) enabled by default, as further described in the Privacy Policy. Certain features may rely on providers or models that do not support ZDR; where that is the case, the feature is clearly indicated in the Service at the time it is used. Your use of such third-party services is subject to their respective terms of service and privacy policies. Pulzer is not responsible for the availability, accuracy, or performance of third-party services.
10. Termination
- 10.1 Termination by You. You may discontinue your use of the Service at any time by deleting your account through the settings of the Service.
- 10.2 Termination by Pulzer. Pulzer may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including for any violation of these Terms. Upon termination, your right to access and use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 6, 11, 12, 13, and 14.
11. Disclaimers of Warranty
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Pulzer does not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will be preserved. To the maximum extent permitted by applicable law, Pulzer disclaims all warranties with respect to the Service.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Pulzer and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, loss of data, loss of goodwill, or interruption of use, arising out of or in connection with your use of, or inability to use, the Service. Because the Service is provided at no charge, the aggregate liability of Pulzer for all claims arising out of or relating to the Service shall not exceed the amount paid by you to Pulzer for the use of the Service during the twelve (12) months preceding the claim, which amount shall be zero (US$0.00) to the extent the Service is provided free of charge. Pulzer shall not be liable for the loss of any data, including data rendered permanently inaccessible as a result of the loss of your password or recovery phrase.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pulzer and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with (a) your use of the Service; (b) your Content; or (c) your violation of these Terms or any applicable law.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state and federal courts located in the State of Texas, and you hereby consent to the personal jurisdiction of such courts.
15. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable or, if it cannot be so modified, shall be severed, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Pulzer with respect to the Service and supersede all prior and contemporaneous agreements and understandings.
16. Changes to These Terms
Pulzer may revise these Terms from time to time. The revised Terms will be posted at this URL with an updated "Last updated" date. Your continued use of the Service after the posting of revised Terms constitutes your acceptance of such revised Terms.
